The Terms and Conditions of Use

[Chapter 1 General Provisions]

Article 1 (Objective): The objective of the Terms and Conditions of Use (the “Terms of Use”) is to stipulate the rights, obligations, and responsibilities of the users (the “User”) in terms of the membership and the use of the services of a website ( http://www.themnk.co.kr/) operated by MNK Co., Ltd. (“MNK”).
Article 2 (Definitions): ① “MNK” also means a business operator that runs a virtual business place and a website to provide goods or services for the User through information and communications, including computers and others, making it possible to trade goods or services.; ② “User” means members and non-members who either connect to or visit MNK to have access to services provided by MNK in accordance with the Terms of Use.; ③ “Member” means a person who provides MNK with his/her personal information and registers as a member, so the person continues to be provided with information on MNK and have access to services offered by MNK.; ④ “Non-member” means a person who uses services provided by MNK without registering as a member.
Article 3 (Notice and Revision): ① MNK may post the contents of the Terms of Use, the company name, and contact information (phone, fax number, e-mail address, and others) to which the User has easy access.; ② MNK may revise the Terms of Use without violating the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Commerce, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., the Act on Door-to-Door Sales, etc., and the Act on the Consumer Protection in Electronic Commerce, etc., and related Acts and statutes.; ③ In the event of any revision to the Terms of Use, MNK may notify an applicable date and reasons for the revision as well as the existing Terms of Use on the first page of the website from seven days prior to the applicable date, to the day before the applicable date.; ④ Where MNK intends to revise the Terms of Use, the revised Terms of Use shall apply solely to any contract made after such applicable date, while the provisions under the Terms of Use before the revision apply to any contract concluded before the applicable date. Provided that the User signing a contract notifies MNK of the intention of applying to the provisions of a revised terms of use within the period of notification of a revised terms of use under paragraph (3) and obtains the approval of MNK, this case shall apply to the provisions of a revised terms of use.; ⑤ Matters and interpretations unless otherwise stipulated in the Terms of Use shall apply in accordance with the Guidelines for Consumer Protection in Electronic Commerce, etc., related Act and subordinated statue, and commercial practice.
Article 4 (Provision and Change of Services): ① MNK will provide the following services:
Providing information on goods and products and signing purchase contract.
Delivering goods or products under the purchase contract.
Other services stated by MNK.; ② Where any goods are out of stock or any change in technical specifications occurs, MNK may change the contents of goods/products provided it is in accordance with the expected contract to come.; ③ Where there is any change in the contents of services signed with the User provided by MNK as a result of the out-of-stock goods or changes in technical specifications, MNK shall not indemnify any damages to the User arising from such results. Provided that the intention and negligence fall on MNK, this shall apply.
Article 5 (Disruption of Services): ① In the event of any reasons, such as the maintenance of computers and information & communications equipment and the interruption of communication, MNK may temporarily disrupt the provision of services.; ② In the event of the disruption of services under paragraph (1), MNK may provide notification to the User in accordance with the method pursuant to Article 8.; ③ In the event that the disruption of service provision causes damages to the User or any third party resulting from paragraph (1), MNK is not liable to compensate for the damages. Provided that the intention and negligence fall on MNK, this shall apply.
Article 6 (Applying for Membership): ① The User of MNK agrees to the Terms of User in accordance with the process of registration stated by MNK and enter member information in order to apply for membership.; ② MNK may register a member among the Users applying for membership defined in paragraph (1) unless the Users fall under any of the following subparagraphs:
Where a membership applicant has been disqualified under Article 7 (3). Provided that a person has three years after the disqualification of the membership and obtains the approval of reapplying membership registration, this shall not apply.
Where there is false entry, omission, and mistaken record.
Where it is deemed to cause remarkable disturbances to MNK’s technical matters if such membership reapplicant is registered.; ③ The membership registration contract is concluded at the time when the User has completed the process of the membership application unless MNK notifies the rejection of the membership application otherwise.; ④ Where there is any change in the matters of registration defined in Article 15 (1), a member shall immediately notify such changes to MNK through email and other ways.
Article 7 (Withdrawing and Disqualifying Membership, etc.): ① 회원은 '주식회사엠엔케이'에게 언제든지 탈퇴를 요청할 수 있으며 주식회사엠엔케이는 즉시 회원 탈퇴를 처리합니다.; ② 회원이 다음 각 호의 사유에 해당하는 경우, '주식회사엠엔케이'는 회원자격을 제한 및 정지시킬 수 있습니다.
가입 신청시에 허위 내용을 등록한 경우
'주식회사엠엔케이' 를 이용하여 구입한 재화또는상품 등의 대금, 기타 '주식회사엠엔케이' 이용에 관련하여 회원이 부담하는 채무를 기일에 지급하지 않는 경우
다른 사람의 '주식회사엠엔케이' 이용을 방해하거나 그 정보를 도용하는 등 전자거래 질서 를 위협하는 경우
'주식회사엠엔케이' 를 이용하여 법령과 이 약관이 금지하거나 공서양속에 반하는 행위를 하는 경우; ③ '주식회사엠엔케이' 회원 자격을 제한,정지 시킨 후, 동일한 행위가 2회이상 반복되거나 30일이내에 그 사유가 시정되지 아니하는 경우 '주식회사엠엔케이'는 회원자격을 상실시킬 수 있습니다.; ④ '주식회사엠엔케이'가 회원자격을 상실시키는 경우에는 회원등록을 말소합니다. 이 경우 회원에게 이를 통지하고, 회원등록 말소 전에 소명할 기회를 부여합니다.
제8조(회원에 대한 통지): ① '주식회사엠엔케이'가 회원에 대한 통지를 하는 경우, 회원이 '주식회사엠엔케이'에게 제출한 전자우편 주소로 할 수 있습니다.; ② '주식회사엠엔케이'는 불특정다수 회원에 대한 통지의 경우 1주일이상 '주식회사엠엔케이' 게시판에게시함으로서 개별 통지에 갈음할 수 있습니다.
제9조(구매신청): '주식회사엠엔케이'이용자는'주식회사엠엔케이'상에서 이하의 방법에 의하여 구매를 신청합니다.
1.성명, 주소, 전화번호 입력
2.재화 또는 상품의 선택
3.결제방법의 선택
4.전화로 구매신청하는 방법; 구매신청의 취소는 상품 배송 절차가 시작되기 이전까지 해야 합니다. 당회사 영업시간중에 유선으로 통보하여야 합니다.
제10조 (계약의 성립): ① 주식회사엠엔케이는 제9조와 같은 구매신청에 대하여 다음 각 호에 해당하지 않는 한 승낙합니다.
신청 내용에 허위, 기재누락, 오기가 있는 경우 기타 구매신청에 승낙하는 것이 주식회사엠엔케이 기술상, 및 업무 수행상 현저히 지장이 있다고 판단하는 경우; ② '주식회사엠엔케이' 승낙이 제12조 제1항의 수신확인통지형태로 이용자에게 도달한 시점 에 계약이 성립한 것으로 봅니다.
제11조(지급방): '주식회사엠엔케이'에서 구매한 재화 또는 상품에 대한 대금지급방법은 다음 각 호의 하나로 할 수 있습니다.
1.계좌이체
2.신용카드결제
3.온라인무통장입금; ① 회원이 상품을 구입할 때 사용할 수 있는 결제 수단에는 신용카드, 온라인 송금, 사이버캐시 등이 있습니다.; ② 신용카드는 회원의 동의를 얻어 등록한 후 사용할 수 있습니다.; ③ 온라인 송금은 회원이 직접 주식회사엠엔케이(주식회사엠엔케이) 계좌로 돈을 입금하는 방식입니다.; ④ 사이버캐시는 '주식회사엠엔케이'에서 현금처럼 사용할 수 있습니다.; ⑤ 인터넷 뱅킹은 인터넷을 통해 다른 은행 계좌에서 주식회사엠엔케이 계좌로 직접 계좌 이체해 결제하는 방식입니다.
